EMPS Verification Site Terms and Conditions You must read and accept the terms and conditions that rule the use of this site before you can start capturing inquiries. By entering this Site, you acknowledge and agree that this Site will only be construed and evaluated according to South African law. EMPS will not forward this information to any organization that is not directly involved in some manner in the provision of this service by EMPS. Although the information contained in this Site is based upon verified, current information, and while EMPS makes all reasonable efforts to ensure that all material on this Site is correct, accuracy cannot be guaranteed and EMPS makes no warranties or representations as to its accuracy. By entering this Site, you acknowledge and agree that all names, graphics, logos and trademarks contained on this Site are owned or licensed either by EMPS or by other parties who have authorised their use on this site, and may not be used in any way by you without the prior written approval of EMPS or the party concerned. EMPS thus suggests that you periodically visit this page to see that you accept the content. 3rd party indemnity In order to use this site it is vital that you are in acceptance of the following indemnifying conditions. If you are an Agent of a 3rd Party Company capturing verification requests on behalf of a subject, you hereby acknowledge that you, in your capacity as an agent of your Company, have FULLY informed the subject concerned of his or her own rights regarding individual privacy, and have obtained the subjects permission, in writing, to perform verification checks. You are expressly charged with the responsibility of keeping and maintaining signed copies of all personal indemnity forms received from your candidates/clients. In certain instances, you are required to forward a copy of the signed indemnity form to EMPS before the verification inquiry can be processed. You will be notified of this by the Site. Personal Indemnity You may only perform verification checks against a subject if the results of the tests can have a material effect on the subject's employment position. As a 3rd Party Agent, you are bound by the following rules; 1) You must obtain the permission, in writing, of the subject of the verification. 2) You must inform the subject of the verification of your intent to perform verification checks.3) You must inform the subject of the verification of the results of the verification checks that have been completed. As a private individual performing verification checks on your own behalf, you hereby authorize EMPS (Pty) Limited to forward your personal information to verification agents acting on behalf of EMPS (Pty) Limited (including but not limited to the South African Criminal Record Centre, the South African Police Services, the Government of the RSA, and any relevant credit and educational, training organizations) for the purpose of your verification. You furthermore authorize the agents of EMPS (Pty) Limited to furnish personal information regarding your criminal, credit background and educational records to EMPS (Pty) Limited. You also unconditionally indemnify EMPS (Pty) Limited and its agents against any liability that may result from furnishing information in this regard. Privacy policy In the context of this document, 'Client' means any company, company employee or individual who has registered with the EMPS Online web site with the intent of making use of the services provided by the site. These services are explicitly presented by the web site itself. These services are explicitly presented by the web site itself. EMPS Payment Terms EMPS offers three payment methods for the services rendered on this site. These are via Debit Order, Direct Deposit and, under strictly controlled conditions, via agreed terms. Payment via agreed terms is only available to qualifying, registered clients. Please note that, while all inquiries will be received by EMPS (Pty) Limited, they will NOT BE PROCESSED until proof of payment has been received by EMPS. Payment by Debit Order is authorized by the Client via a letter of approval. A discount is applicable to those clients utilizing the debit order option. Payment by Direct Deposit is authorized offline, and EMPS (Pty) Limited is informed of the authorization at timed intervals. The authorization process has an impact on the inquiry feedback turnaround time. It is in your best interests to effect the deposit as soon as possible after you have captured the inquiry. Payment on Invoice of agreed terms is only available on request to qualifying clients who are registered as such on EMPS's systems. In addition, a Terms Agreement depends upon several criteria and conditions, all at the sole discretion of EMPS. These include, but are not limited to, contractual agreements, historical transaction volume, credit rating and locale. TERMS & CONDITIONS PERTAINING TO THE SA FRAUD DATABASE Whereas, South African Fraud Prevention Service (hereinafter referred to as “SAFPS”) a section 21 non- profit organisation providing fraud data to its members and associated fraud prevention organisations It is therefore hereby agreed that both parties accept the following terms and conditions 1. The Registered User hereby accepts that EMPS and SAFPS cannot be held responsible for any incorrect information or data that may be disseminated by EMPS and SAFPS and accepts that EMPS and SAFPS act in good faith in such dissemination. 2. The Registered User hereby indemnifies EMPS and SAFPS, their members, agents and servants, other Registered users against all or any actions in whatever form that may result from any data or information received by the Registered User. 3. The Registered User accepts that it may not use the data received by it from EMPS and SAFPS to base any business decision, either of a legal or other nature, only on such data and shall consider all other available data when making any decision regarding the data provided by SAFPS. 4. The Registered User agrees that all frauds detected by such Registered user during the normal course of business will be filed to the SAFPS Shamwari system through EMPS. 5. Should data received and processed by SAFPS from the Registered User clearly indicate fraudulent conduct on the part of the subject, the Registered User hereby authorises and agrees that SAFPS may file such subjects particulars to the SAFPS Shamwari system. 6. The Registered User agrees not to disseminate or share any data received by it from SAFPS through EMPS with any other organisation, person or concern, who is not a member or Registered User of SAFPS, as a result of its participation as a Registered User of the SAFPS systems. 7. The Registered User accepts and agrees that all data forwarded by it to SAFPS for analysis shall become part of the SAFPS Shamwari system unless the Registered User clearly indicates that such data should not be so filed and provides reasons therefore. 8. The Registered User further agrees that all fraud identified during the course of business and which can be filed to the Shamwari system at SAFPS shall be submitted to EMPS for such filing within 24 hours of the incident having occurred. Such data shall be forwarded to EMPS in the format as indicated from time to time by EMPS. 9. The Registered User hereby agrees that any data provided to SAFPS and filed under any category of the Shamwari system shall be made available to SAFPS members and other Registered users of the SAFPS systems. The Registered User further indemnifies EMPS and SAFPS, their Directors, members, Agents, Servants and other Registered Users against any action, legal or otherwise regarding the provision of data. 10. EMPS and SAFPS will take reasonable measures to ensure that the data matching will be as accurate as possible. However, EMPS and SAFPS make no claims, promises, or guarantees about the accuracy, completeness, or adequacy of the information being provided. Further, EMPS and SAFPS, and their officers, directors, members, authors, or agents shall not be liable for any loss, damage, inaccuracy or claim with respect to any such information being provided. All such liabilities, including direct, special, indirect, or consequential damages, are expressly disclaimed and excluded. 11. The Registered User agrees to abide by the SAFPS Code of Conduct as applicable and which will be provided free of charge on registration.
